Our income tax system has been described as a disgrace by Jimmy Carter and a lot worse by millions of income tax filers on April 15th. Our federal income tax system has grown by leaps and bounds to the point where the IRS cannot even keep up with understanding all of the new laws.

Income Tax Planning

There are three parties involved in most business transactions: a buyer, a seller, and the IRS, or income tax man. Overlook the income tax consequences of your business transaction and you will pay dearly in additional income taxes, penalties and interest imposed by the IRS. My income tax planning process begins with a review of your income tax situation, then I research the applicable IRS rules and regulations to identify specific strategies, implemented by the client that legitimately avoids or postpones the payment of income tax.
 

Any tax planning should be designed to withstand a challenge from the IRS. As an individual taxpayer, and as a business owner, you will often have the option of completing a taxable transaction by more than one method. The courts strongly back your right to choose the course of action that will result in the lowest legal income tax liability. In other words, income tax avoidance is entirely proper.

Forget about our income tax system being voluntary! The IRS watches for those who file a return one year and skip filing the next year. Individuals, meeting IRS income requirements, are required to file a federal income tax return every year. In fact, the IRS has a criminal investigation division that investigates and refers for prosecution those who fail to file an income tax return.

My income tax preparation services ensure that my clients pay no more tax than the IRS requires. Over the past 18 years I have prepared thousands of individual and corporate income tax returns, from the most basic to the most complicated. Every year, I pay thousands of dollars to purchase a tax return software program with a very strong diagnostic feature that alerts me to potential errors or problems with the return. This, combined with my IRS experience, provides my clients with an extra measure of insurance against IRS computers finding a technical or math error that could result in additional taxes, interest and penalties.

Income Tax Audit

Beware: The IRS Tax Audit Process is an Adversarial Relationship!

Because I worked as an IRS Field Auditor for six years, and since I stay abreast of current IRS audit practices, I have a special insight to the IRS audit process. In several instances where I became involved after the initial audit, IRS auditors tried to intimidate and bully the client into paying more tax than they owed. This is an absolute disgrace and I have fought it vigorously and successfully.

Being prepared for the IRS tax audit is half the battle, and includes gathering your records and having an idea as to the questions you will be asked. Knowledge of income tax laws, regulations and case law is the other half. This is why I maintain an extensive income tax library.

In an IRS audit, rule number one is to separate the taxpayer from the auditor. Sign a power of attorney and either have a CPA go to the IRS with your records or have the IRS auditor go to your CPA office. You do not need to be present for the IRS audit. Finally, always keep in mind that an IRS auditor only proposes adjustments to your income tax return. There are several IRS administrative and judicial reviews available to you after the initial audit process.
